Welcome to Homeward Australia (“Homeward”, “we”, “our”, “us”).

These Terms & Conditions (“Terms”) govern your use of our website and services.

By accessing our site, engaging our services, or making a payment, you agree to be bound by these Terms and our Privacy Policy.

2. Our Services

Homeward Australia provides nationwide relocation and rental-search support, including:

* Property research and suburb shortlisting

* Virtual or in-person inspections (via local representatives)

* Rental application preparation and submission support

* Lease liaison with real estate agencies and property managers

* School, neighbourhood, and utilities guidance for new arrivals

We act as a **facilitator and advisor** — not a real estate agent, property manager, or landlord unless otherwise stated under a separate licensed entity.

All final property decisions, applications, and lease agreements are between you (the tenant) and the property’s landlord or managing agent.

3. Client Responsibilities

You agree to:

* Provide accurate and complete information during the relocation process

* Review and approve all documents before submission

* Ensure all required identification, income, and reference documents are genuine

* Make final decisions about which properties to apply for or accept

* Conduct your own due diligence regarding locations, schools, and lease terms

Homeward will not be responsible for outcomes affected by incomplete or incorrect information provided by you.

4. No Guarantee of Outcomes

We aim to provide professional support, but we cannot guarantee:

* Rental application approval

* Availability of any particular property

* Timeframes for securing housing

* Outcomes based on third-party decisions (e.g. landlords, agents, councils)

5. Fees, Payments & Refunds

5.1 Fees

All Services are subject to the current pricing schedule or a written proposal accepted by you.

5.2 Payments

Payment must be made in advance unless otherwise agreed. We accept payment via credit card, bank transfer, or other approved methods.

5.3 Refunds & Cancellations

* If you cancel before work begins, a partial refund may apply (less admin costs).

* Once property research or inspections have commenced, no refund is available.

* Fees for additional services (e.g. extra inspections, fast-track assistance) are non-refundable once performed.

Refunds are assessed in line with the Australian Consumer Law (ACL).

6. Use of Website & Materials

You may use our website and materials for personal, non-commercial purposes only.

All guides, reports, and templates remain the intellectual property of Homeward Australia.

You must not copy, modify, distribute, or resell our materials without written consent

7. Privacy & Data Use

8. Liability & Disclaimer

Nothing in these Terms excludes, restricts, or modifies any consumer rights under the **Australian Consumer Law (ACL)** that cannot be excluded.

**8.2 Limitation of Liability**

To the extent permitted by law, Homeward and its officers, employees, and contractors are not liable for:

* Indirect or consequential losses (e.g. stress, loss of opportunity, missed properties)

* Decisions made by landlords, real estate agents, or third parties

* Events outside our reasonable control (e.g. travel delays, housing shortages, natural disasters)

Our total liability for any claim is limited to the total Service Fees paid by you for the relevant engagement.

**8.3 Indemnity**

You agree to indemnify Homeward against any loss, liability, or expense arising from your breach of these Terms or misuse of our Services.

9. Termination & Suspension

Either party may terminate services with written notice.

You must pay for all Services delivered up to the termination date.

We may suspend or cease Services immediately if:

* Payments are overdue

* You breach these Terms

* We suspect fraudulent, abusive, or unlawful activity

10. Dispute Resolution

If a dispute arises, both parties agree to attempt good-faith negotiation.

If unresolved, mediation may be sought before formal legal action.

These Terms are governed by the laws of Australia.

You agree to submit to the jurisdiction of the courts of your state or territory of residence.

11. Changes to Terms

We may amend these Terms at any time by posting the updated version on our website.

Continued use of our Services after changes constitutes acceptance of the revised Terms.
